Council plans meeting; two members resign

After two prior Minco City Council meetings failed to reach the five-member quorum necessary to conduct a meeting, the Council is slated to hold a Public Hearing and Special Meeting on Thursday, June 3, at 6:30 p.m.

Reaching a quorum may prove to be more challenging at the next meeting.

Council members Michelle Overton and Hoppy Bomgardner resigned from their Council positions on May 25. Both resignations are from the same council ward.

Title 11 O.S. Section 1-102 defines a quorum as a majority of the members of the governing body, including vacant positions. In order to reach a quorum, five of the remaining six Council members must be in attendance.

The May 17 monthly meeting of the City Council failed to have quorum when five Council members exited prior to the meeting’s call to order. Council members were concerned about the exclusion of the public witness item from the agenda.

Council members Jimmy Rice, Shirley Oaks, Shaun Bliss and Susan Hollandsworth called a special meeting for Tuesday, May 25, to pay the city’s bills. The meeting fell one member short of a quorum.

Vice Mayor (Council President) Shirley Oaks was prepared to preside over the meeting in the absence of Mayor Keith McMullen, who was out of town. Oaks would have retained her voting rights and counted as a member of the quorum at that meeting under Title 11 O.S. 9-107, which states, “The council president shall act as mayor during the absence, disability, or suspension of the mayor. He shall preside at all meetings of the council during the absence of the mayor and while presiding in the place of the mayor, he shall have all the powers, rights, privileges and duties as other members of the council.”

June 3 will be the third attempt to gather a quorum to conduct business for the month of May. The public hearing concerning the city’s proposed 2010- 2011 budget will be held at 6:30 p.m. Thursday, June 3. The proposed budget is published on page 2 of the Minco Millennium newspaper.

The City Council meeting will immediately follow the public hearing. Agenda items to be discussed include Minco entering into a Master Economic Development Agreement with Calumet, Geary, Hinton, Okarche, Union City, El Reno, Kingfisher, Piedmont and Watonga to form the Central Oklahoma Regional Development Partnership for Fiscal Year 2010-2011; Executive session discussing the employment and promotion of police officers relating to starting salary and step increases in annual pay of police officers, the employment and promotion of Officer Mycal Prince, the employment and promotion of Officer Brian Lenington, and the employment of an assistant to the City Clerk; Discussion on adopting Ordinance Number 03-2010.

ORD codifying the 2010 Code of Ordinances of the City of Minco, adopting an emergency clause for the ordinance, and discussion of Resolution 04-2010.ORD memorializing passage and codification of the 2010 Code of Ordinances; Discussion to use the loss fund in the amount of $11,478.34 to the 2010-11 the renewal on the Worker’s Comp towards the premium of $13,898.96; Discussion of the Fiscal Year 2010-2011 budget. The Minco Code of Ordinances must be recodified every ten years. The last recodification was passed on June 8, 2000.

Because the ordinances were not recodified by June 8, 2010, the city cannot enforce changes made to the ordinances since the last codification in 2000. As a result, the costs of municipal tickets must be assessed at the 2000 rate and tickets cannot be issued for violations of ordinances passed since June 8, 2000.

The revised ticket schedule and ordinances will go into effect 30 days after the Council passes the recodification ordinance unless the Council also passes the emergency provision, which will make the recodification effective immediately.

The Minco Municipal Authority agenda items to be discussed are proposed action to clean approximately two miles of raw water lines from the wells to the water plant at a cost of approximately $700 and approval of the Fiscal Year Municipal Authority budget.

Although Overton’s and Bomgardner’s resignations are not listed as agenda items, the resignations can be discussed under the new business agenda item.

The Council has 60 days from the date of resignation to fill the vacant council seats by appointment. If the seat is not filled by appointment within 60 days, a special election must be held. Appointed council members may hold the seat until the next municipal election in 2011. If a special election is held, the elected council members will fill the unexpired term.

Overton ran for council unopposed in 2009. Her term would have expired in April 2013.

Bomgardner filled the council vacancy created by Keith McMullen, who ran unopposed for the mayor’s open position. Bomgardner’s seat would have been up for election in 2011.

The mayor, chief of police, and council seats held by Debi Keeble, Shirley Oaks, Keith Horn, and the vacant seat held by Bomgardner are up for election in the April 2011 election.
